1. Scope and Acceptance
These Terms & Conditions (“Terms”) apply to the website operated by Rashtriya Electrical & Engg. Corporation (“Rashtriya Electrical”, “we”, “us” or “our”) and to product enquiries, quotations, orders and sales made through or in connection with the website.
By placing an order, accepting a quotation or written order confirmation, or purchasing a product from us, you agree to the version of these Terms applicable at that time together with the final written quotation or order confirmation. If those documents conflict, the final written quotation or order confirmation takes precedence for that transaction.
2. Product Information and Specifications
We aim to present product descriptions, specifications, images, dimensions, ratings and other information accurately. Images are illustrative, and appearance may vary because of manufacturing tolerances, product improvements, display settings or an agreed custom specification.
Technical data must be reviewed against the intended application before an order is confirmed. Specifications contained in the final written quotation, approved drawing, datasheet or order confirmation govern the supplied product. We may make changes needed to comply with law, safety or technical requirements provided they do not materially reduce the agreed product specification.
3. Website Prices, Taxes, Shipping and Negotiated Quotations
Website-listed transactions
Product prices displayed on the website apply only to the product, quantity, specification and other conditions shown with that price. Unless the website or order confirmation expressly states that tax is included, applicable GST or other taxes may be added as required by law and shown before final order confirmation.
Negotiated transactions
If a customer negotiates product price, quantity, specification, payment, shipping or another commercial condition with a Rashtriya Electrical sales executive, the final written quotation or order confirmation supersedes the general website price and the shipping arrangement associated with that website price.
For a negotiated transaction, freight, transportation, courier, packing, forwarding, insurance or special-delivery charges may be quoted separately where applicable. Those charges may vary according to the final negotiated terms, shipment size or weight, destination, urgency and transportation requirements.
The applicable freight and shipping terms will be stated or made available to the customer before final order confirmation. A customer is not required to confirm an order without first having the opportunity to review those terms.
4. Orders and Availability
A website enquiry, quotation request or form submission is not an accepted order. An order becomes binding only when we issue or accept a final written order confirmation, receive any required payment, and confirm the applicable product and commercial terms.
Products, materials and production capacity are subject to availability. If we cannot supply an ordered product, we may propose a revised lead time, suitable alternative or cancellation. Any alternative requires the customer's agreement. We may decline an order for a legitimate reason, including an obvious pricing or description error, non-availability, payment or compliance concerns, or inability to meet the requested specification.
5. Payment
Price, currency, payment method, deposit, credit period, milestone and balance requirements are those stated in the final written quotation or order confirmation. Payment must be made by the due date and through the agreed channel. We may pause production, dispatch or delivery where an amount due remains unpaid, subject to the confirmed terms and applicable law.
The customer is responsible for supplying accurate billing and tax information. Bank, payment-provider or government charges not expressly included in our confirmation remain the responsibility of the party to whom they are charged.
6. Delivery
Delivery dates and lead times are estimates unless expressly agreed in writing as fixed. Timing may depend on payment, technical approvals, material availability, production, inspection, transportation and events outside reasonable control. We will make reasonable efforts to communicate a material known delay.
The customer must provide complete delivery information and ensure that the destination can safely receive the shipment. Delivery method, part shipments, risk, title, insurance and related charges are governed by the final written quotation or order confirmation and applicable law.
7. Inspection on Delivery
The customer should inspect the shipment promptly after delivery for visible transit damage, shortages, incorrect products and apparent defects. Where possible, visible package damage or shortages should be recorded on the carrier's delivery document and supported with photographs, package labels and other relevant evidence.
Notify us without unreasonable delay and within any inspection or notice period stated in the final written quotation, order confirmation or warranty. A delayed notice does not remove any right that cannot lawfully be excluded, but may limit our ability to verify transit damage or arrange an effective remedy.
8. Return and Replacement Policy
To request a return or replacement, contact us using the details below and provide the order or invoice reference, product details, a clear description of the issue, and reasonable supporting evidence such as photographs, video, test results or carrier documentation. Keep the product, accessories and packaging available for inspection.
A product must not be returned without our written instructions or authorisation. We may inspect or test the product, request further evidence, or arrange collection or another verification method. Approval of a return request is not by itself an admission that the product is defective or that a particular remedy is due.
If a claim is verified as eligible, we will provide the remedy stated in the applicable warranty or written agreement, normally repair, replacement or exchange within a reasonable time. Where replacement is not reasonably available, or where applicable law or a written agreement requires it, another appropriate remedy may be offered.
Responsibility for collection, return freight and re-delivery will be determined according to the cause of the issue, the confirmed shipping terms, the applicable warranty and applicable law. We will communicate any customer-payable charge before the return is authorised.
9. Return and Replacement Exclusions
Unless required by applicable law or expressly agreed in writing, a return, replacement or warranty remedy may be refused where the issue results from:
- incorrect storage, handling, installation, commissioning, maintenance or use;
- use outside the product's specified ratings, environment or intended application;
- accident, misuse, neglect, abnormal electrical or mechanical conditions, contamination, normal wear, or an external event;
- unauthorised repair, alteration, dismantling or modification;
- a specification, drawing, sample, instruction or other information supplied or approved by the customer;
- a change of mind, excess quantity or ordering error after a conforming product has been supplied; or
- damage occurring during transportation arranged independently by the customer, except to the extent another party is responsible under applicable law.
Custom-made, configured or specially procured products are not returnable merely because requirements change after confirmation. This section does not exclude rights or remedies that cannot lawfully be excluded.
10. Cancellation
A customer may request cancellation before dispatch, but cancellation is effective only when accepted by us in writing. We may take into account work completed, materials procured, non-recoverable charges and commitments made for the order. Custom, configured or specially procured products may not be cancellable once production or procurement has begun.
We may cancel or suspend an order where payment is not received, required technical approval is withheld, fulfilment becomes unlawful or impossible, or another material confirmed condition is not met. Any amount due or repayable following cancellation will be determined under the final written terms and applicable law.
11. Warranty
Product-specific warranty coverage, duration, conditions and remedies are those stated in the final written quotation, order confirmation, invoice, warranty document or applicable manufacturer's terms. A warranty applies only to the product and conditions it expressly covers and does not create a promise of suitability for an application we have not approved in writing.
Warranty claims are subject to reasonable verification and the exclusions described in these Terms or the applicable warranty. Nothing in these Terms limits a mandatory warranty or statutory right that cannot lawfully be excluded.
12. Installation and Use
Electrical products must be selected, installed, tested, commissioned, operated and maintained by appropriately qualified persons in accordance with product documentation, approved drawings, relevant standards, site conditions and applicable safety laws. The customer is responsible for confirming system compatibility and suitability unless we expressly accept that responsibility in writing.
Do not use a product that appears damaged, altered or unsuitable for the intended service. Contact us before installation if clarification of a specification or supplied condition is required.
13. Intellectual Property
The website and its text, layout, logos, graphics, photographs, product information, downloads and other content are owned by or licensed to Rashtriya Electrical and are protected by applicable intellectual-property laws. You may view or download content for legitimate evaluation of our products or business dealings with us.
You may not reproduce, republish, sell, modify, distribute, scrape or exploit website content for another commercial purpose without prior written permission. Third-party names and marks remain the property of their respective owners.
14. Third-Party Links
Links to third-party websites or services are provided for convenience and do not imply endorsement. We do not control and are not responsible for third-party content, availability, security, terms or privacy practices. Use of a third-party website is governed by that third party's terms.
15. Website Availability
We aim to keep the website accurate and available, but access may be interrupted for maintenance, security, updates, technical faults or events outside our reasonable control. We may change, suspend or discontinue website content or functionality without guaranteeing uninterrupted or error-free access. Confirm time-sensitive product and commercial information with us before relying on it.
16. Liability
To the maximum extent permitted by applicable law, neither party is responsible to the other for an indirect, incidental or consequential loss that was not reasonably foreseeable when the order was confirmed. Product-related responsibility is assessed under the final written quotation or order confirmation, the applicable warranty, these Terms and applicable law.
We are not responsible for loss caused by inaccurate information supplied by the customer, use outside confirmed specifications, improper installation or maintenance, unauthorised modification, or events outside reasonable control. Nothing in these Terms excludes or limits liability, rights or remedies that cannot lawfully be excluded or limited.
17. Privacy
Our handling of personal information submitted through this website or in connection with an enquiry is described in our Privacy Policy. Please review it before providing personal information.
18. Governing Law and Disputes
These Terms and transactions with Rashtriya Electrical are governed by the laws applicable in India, unless the final written quotation or order confirmation validly states otherwise. The parties should first attempt in good faith to resolve a dispute through written communication. Subject to mandatory law and any valid written dispute arrangement, proceedings may be brought before a court of competent jurisdiction in India.
19. Updates to These Terms
We may update these Terms to reflect changes in our website, commercial practices or legal requirements. The revised Terms will be posted on this page with an updated date. Changes apply from their stated effective date and do not by themselves replace the terms of a previously confirmed order unless agreed in writing or required by law.
